Terms of Service

1. General Provisions

This User Agreement (“Agreement”) constitutes a legally binding agreement between you (an individual or a single entity) (“User”) and IE Borys Spektor (“Company”) regarding the use of the watermark service (“Service”).

By using our service, you agree to comply with the terms of this Agreement. If you do not agree to the terms, please discontinue use of the service.

The Company may change this Agreement at any time without special notice.

2. Free Use

All basic functions of our service are available for free and without registration. We do not collect information about your device or identity when using the free version.

The free version of the service adds an additional watermark to processed images.

You can test the service for free to ensure it meets your requirements. If the free version suits you, you can purchase an upgrade to the paid version.

3. Purchase Terms

Upon purchase, the User pays for a license key that activates additional service features on the corresponding number of devices. All service updates are provided free of charge.

All listed prices are one-time payments.

We will send you an activation key immediately after purchase. The key allows you to unlock additional features. The key is valid indefinitely and never expires.

License type changes are possible 10 days after activation of the current license.

Key Recovery:

• Basic version: 60 days after purchase
• Plus version: 2 years after purchase
• Premium version: 10 years after purchase

4. Refund Policy

All our products offer a trial period, and we recommend testing the service for free before purchasing.

Full refund:

• Within 30 days of purchase without explanation
• License key is blocked upon refund issuance

After 30 days:

• All requests are considered individually
• Refund decisions are made by company management

Refund conditions. To receive a refund, you must:

1. Remove all watermarked images, including those uploaded to social networks
2. Contact customer support

Refund processing time: 5-10 business days depending on payment method.

5. License Restrictions

Permitted:

• Use on physical devices
• Creating backup copies for archival purposes

Prohibited:

• Modification, copying, or adaptation of the service
• Reverse engineering, disassembly, or attempts to obtain source code
• Removal or alteration of copyright notices
• Commercial rental or sublicensing of the service to third parties
• Use on virtual machines, rented equipment, servers with multiple access
• Transfer of license to third parties

6. Limitation of Liability

Under no circumstances shall the Company be liable for any damages, claims, or costs, including indirect, incidental losses, lost profits, or data loss.

The Company’s aggregate liability is limited to the amount paid for the service.

7. Warranties

The Company warrants that the service provides the functionality described in the documentation during the warranty period:

• 1 year for corporate users
• 2 years for private users

8. Intellectual Property

The Company retains all rights, title, and interest in the service, including all intellectual property rights.

Copyright: Unauthorized use and/or duplication of materials without written permission is strictly prohibited. Excerpts of up to 100 words are permitted provided an active link to our website is included.

9. Personal Information

Processing of personal data is governed by our Privacy Policy.

10. General Provisions

Severability: If any part of this Agreement is deemed invalid, it does not affect the validity of the remaining provisions.

Modifications: The Agreement may only be modified by a written document signed by an authorized representative of the Company.

Entire Agreement: This is the complete agreement between the parties, superseding all previous arrangements.

11. Governing Law

This Agreement is governed by the laws of Georgia without application of conflict of law rules.

All disputes shall be subject to the jurisdiction of Georgian courts.
